1. Introduction
Welcome to PebbleStoneWay ("we," "us," or "our"). The following Terms & Conditions ("Terms") manage your engagement with our yacht rental service and the website found at pebblestoneway.sbs (the "Service"), which is run by PebbleStoneWay.
By securing a charter or utilizing our Service, you consent to adhere to these Terms. Should you object to any portion of these terms, you are prohibited from accessing the Service.
2. Service Overview
PebbleStoneWay offers high-end yacht chartering solutions, which comprise the following options:
- Full-day yacht hire
- Evening sailings
- Business outgoings
- Exclusive celebrations
- Extended excursions
Our services are contingent on availability as well as prevailing weather conditions. We retain the prerogative to adjust or withdraw offerings without prior notice.
3. Booking and Reservations
3.1 Booking Process
In order to secure a yacht, you are required to:
- Be of minimum age 18 years
- Submit true and comprehensive details
- Remit the initial deposit as defined in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your reservation is only established upon successful payment and our issuing written acknowledgement. Service to any individual can be denied at our sole discretion.
3.3 Availability
Charters hinge on the availability of vessels and suitable climatic conditions. We will attempt to fulfill your preferred scheduling where feasible.
4. Payment Terms
4.1 Pricing
All rates are expressed in € and comprise relevant taxes unless specified otherwise. Rates are subject to modification without prior notice.
4.2 Payment Schedule
- Initial Payment: 50% of the overall cost of charter due upon reservation
- Final Payment: Due 48 hours prior to the yacht's departure
- Any additional fees (if applicable): Due after concluding the charter
4.3 Payment Methods
Our accepted forms of payment include major credit cards, bank wires, and verified cheques. Payments are processed using secure, encrypted protocols.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full repayment excluding processing costs
- 24-72 hours before departure: Refund of 50%
- Less than 24 hours before departure: No reimbursement
5.2 Weather Cancellations
If our captain determines that the weather is unsafe, we will propose either:
- Rebook your outing to an alternate available date at no extra charge
- Issue a complete refund if rescheduling is unfeasible
5.3 Mechanical Issues
In the unforeseen event of mechanical failings with the assigned yacht, we will strive to provide a comparable substitution. If a substitute is not procurable, a full reimbursement will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are obligated to:
- Obey all directions from the crew
- Wear safety gear as mandated
- Report any health conditions that could compromise their safety
- Stay within the allocated areas on the vessel
6.2 Prohibited Items
The following items are not allowed on board:
- Glass containers
- Illegal substances
- Weapons or firearms
- Excessive quantities of beverages (beyond reasonable refreshment)
- Animals (except when given prior authorization)
6.3 Conduct
Passengers must behave respectfully. A charter can be terminated prematurely without a refund if passenger behavior creates a safety hazard or disrupts the outing for others.
7. Liability and Insurance
7.1 Our Liability
Our financial responsibility is capped to the sum paid for your charter. We shall bear no liability for:
- Injuries due to passenger carelessness
- The theft or destruction of personal belongings
- Indirect, subsequent, or penal damages
- Delays instigated by the weather or scenarios out of our control
7.2 Insurance Coverage
Comprehensive marine insurance that covers our vessels and activities is maintained by us. Passengers are accountable for obtaining their own travel and personal insurance.
7.3 Assumption of Risk
By partaking in our yacht charter services, you accept the inherent dangers associated with maritime activities and assume all responsibility for your own safety and that of your belongings.
8. Modifications and Itinerary Changes
We reserve the right to adjust itineraries, routes, or schedules due to weather conditions, safety concerns, or operational needs. We will endeavor to provide equivalent alternative experiences wherever possible.
9. Force Majeure
Our responsibility does not encompass delays, cancellations, or changes arising from factors outside our sphere of influence, which includes but is not limited to:
- Severe weather events
- Natural catastrophes
- Official ordinances
- Harbor closures
- Vessel malfunctions
10. Privacy and Data Protection
Your private data is managed as per our Privacy Policy. By engaging with our services, you consent to the gathering and utilization of your data as described in our Privacy Policy.
11. Intellectual Property
All material on our site, including text, illustrations, trademarks, and images, are defended by copyright and trademark statutes. Unauthorized reproduction, distribution, or modification is prohibited without our express written agreement.
12. Governing Law
These Terms are subject to the laws in force in Monaco. Any dispute will be settled in the judicial courts of Monaco, Monaco.
13. Changes to Terms
We hold the right to revise these Terms periodically. All alterations will be published on our website with an updated revision date. Continued service usage signifies the acceptance of any amended terms.
